רב יעקב מנהר פקוד

Rav Yaakov of Nehar Pekod

Rav Yaakov of Nehar Pekod — amora of Bavel of the sixth generation and talmid of Ravina; the halacha follows his objection to Rav Kahana in a case of a land sale.

תּוֹלְדוֹת

Rav Yaakov of Nehar Pekod (רב יעקב מנהר פקוד) was an amora of Bavel of the sixth generation and a talmid of Ravina. He came from Nehar Pekod in Bavel; little is known of his family or his life. In several places in the Talmud Bavli he brings, in Ravina’s name, comments on the flow of the sugya, questions and answers. One is in masechet Ketubot, in the sugya of a man who was married to three wives: there he states in Ravina’s name that both the first and the last clauses of the Mishnah speak of property that came into the estate in two separate seizures.

He also brings one statement in the name of Rava and one in the name of Rav Huna brei d’Rav Yehoshua. Most of what is said in his own name are objections and remarks on the course of a sugya; a smaller part are rulings in halacha.

One such ruling: a man told his friend, “If I sell this land, I will sell it to you for a hundred zuz,” and then sold it to someone else for a hundred and twenty. Rav Kahana said the first man acquires it. Rav Yaakov of Nehar Pekod objected that the money forced him: as Rashi explains, had the second buyer not offered so much he would not have sold at all, and his promise was only to sell at its value. The halacha follows Rav Yaakov of Nehar Pekod.

A takanah (communal enactment) is also ascribed to him: to keep a vessel, a natla, holding a revi’it for netilat yadayim.
